Terms Of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the Nerteron Moderation Bot (the “Bot”), a software application that provides automated moderation features for Discord servers. By inviting, installing, or interacting with the Bot, you (“User”, “you”, or “your”) agree to be bound by these Terms. If you do not agree, you must not use the Bot.

2. Eligibility

  • You must be at least 13 years old (or the minimum age required under applicable local law) to use the Bot.
  • You must have the necessary permissions on the Discord server where the Bot is installed (e.g., “Manage Server” or equivalent).
  • You must comply with Discord Rules (https://discord.com/guidelines)

3. License & Access

  • Nerteron grants you a non‑exclusive, revocable, worldwide, royalty‑free license to use the Bot solely for moderation purposes within Discord.
  • This license permit you to copy, modify, distribute the Bot’s source code as it's available on code platform (which have difference with production bot owned by Nerteron). If you use or compile source code on your own, you have not the right to publish it or make it work on Discord under the same name.
  • And the use of the public bot must remain private on your own server.

4. User Responsibilities

  1. Compliance with Discord’s Terms – You must comply with Discord’s Terms of Service, Community Guidelines, and any applicable developer policies.
  2. Appropriate Use – Do not use the Bot to harass, threaten, or discriminate against individuals or groups.
  3. Data Handling – You are responsible for any data (messages, logs, user IDs) the Bot processes on your server. Ensure that its use complies with all relevant privacy regulations (e.g., GDPR, CCPA).
  4. Server Configuration – Configure the Bot’s settings responsibly. Misconfiguration that results in unintended bans, deletions, or privacy breaches is your liability.

5. Nerteron’s Obligations

  • Availability – Nerteron will make reasonable efforts to keep the Bot operational 24/7, but uptime is not guaranteed. Maintenance windows and unexpected outages may occur.
  • Support – Basic support is provided via the official Nerteron Discord support channel or email (support@nerteron.com). Premium support may be offered under separate agreements.
  • Updates – Nerteron may release updates, bug fixes, or new features at its discretion. Updates may be applied automatically.

6. Data Collection & Privacy

  • The Bot processes only the minimal data required for moderation (message IDs, user IDs, timestamps).
  • All processing complies with the Règlement Général sur la Protection des Données (RGPD) and the French Loi Informatique et Libertés.
  • No additional personally identifiable information (PII) is stored beyond what Discord already provides.
  • Retention periods are limited to the duration necessary for moderation or troubleshooting, after which data is securely deleted.
  • Users may exercise their RGPD rights (access, rectification, erasure, restriction, data portability, objection) by contacting legal@nerteron.com.

7. Intellectual Property

  • All rights, title, and interest in the Bot, its code, documentation, and related materials remain the exclusive property of Nerteron.
  • Users may not claim ownership or create derivative works without explicit written permission.

8. Disclaimer of Warranties

The Bot is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability, fitness for a particular purpose, non‑infringement, or security.
  • That the Bot will be error‑free, uninterrupted, or free of viruses or other harmful components.

9. Limitation of Liability

  • Under French law, Nerteron remains fully liable for damages caused by intentional misconduct or gross negligence.
  • For all other cases, Nerteron’s liability is limited to the maximum extent permitted by French law (Article 1242 et seq. du Code civil).
  • To the extent allowed, Nerteron shall not be liable for direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Bot, including loss of data, revenue, or goodwill.

10. Indemnification

You agree to defend, indemnify, and hold harmless Nerteron, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of:

  • Your breach of these Terms.
  • Your misuse of the Bot or violation of applicable law.

11. Termination

  • Nerteron may suspend or terminate your access to the Bot at any time, with or without notice, for any reason, including violation of these Terms.
  • Upon termination, you must remove the Bot from all servers you control.

12. Governing Law & Jurisdiction

  • Applicable Law: These Terms are governed by French law, in particular the provisions of the Code civil, the Code de la consommation, and the RGPD.
  • Jurisdiction: Any dispute arising out of or relating to these Terms shall be submitted exclusively to the tribunaux compétents de Paris (Tribunal judiciaire de Paris). Both parties expressly submit to the jurisdiction of these courts.

13. Changes to the Terms

Nerteron may amend these Terms at any time. Updated versions will be posted on the Bot’s official website or documentation page. Continued use of the Bot after such publication constitutes acceptance of the revised Terms.
